New rules on substantial modification of doors and gates
The rules governing the substantial modification of doors is one of the issues that most concerns the sector, given the number of interventions that are undertaken in this regard and the need to carry out a reassessment in such a case. In the preparation of the report, the opinion of the sector was sought through FIMPA, the Federation of Manufacturers, Installers and Maintainers of Doors, which developed an internal consultation process among its member associations. Subsequently, the FIMPA technical committee submitted its views on the matter to the Ministry, which were partially taken on board in the text finally published.
The report of the Ministry of Industry adds clarification and defines what is considered a substantial modification of doors under the new Machinery Regulation 2023/1230, warning that, although it will not enter into force until 2027, it has a clarifying value, given the absence of a more precise definition in the current Machinery Directive.
This issue is one of the main concerns for the sector given the number of interventions that are carried out on doors and the need to reassess these in such cases, with the obligations that this entails that are outlined in the report.
